General Terms and Conditions of Booking and Stay

 

Preamble
These General Conditions govern the terms and conditions applicable to accommodation bookings and stays at hotel
units operating under the Savoy Signature brand.
The entity responsible for the provision and management of these services is Savoy – Investimentos Turísticos, S.A., hereinafter referred to as “SAVOY”
.
For the purposes of these Terms and Conditions, "Client" shall mean any natural or legal person who makes a
reservation or contracts accommodation services at SAVOY hotel units.


Acceptance of the Terms and Conditions

- By making a reservation or contracting accommodation services with SAVOY, the Client declares having read, understood, and fully accepted these
Terms and Conditions, as well as the Privacy Policy available at www.savoysignature.com/en/privacy-policy.
- SAVOY reserves the right to modify, amend or update these Terms and Conditions to reflect legal, regulatory or operational changes.
Such changes will be published on this page and take immediate effect.
- Certain hotel units, complementary services or specific booking categories, such as group bookings, may be subject to specific terms and conditions,
duly communicated at the time of booking or contracting.
- Discounted service bookings and special rates are subject to specific conditions detailed on the respective rate page.
The Client declares to have taken note of these conditions and undertakes to comply with them fully.


TYPES OF BOOKINGS, CANCELLATIONS AND GUARANTEES.


Flexible Rates

- Bookings with flexible rates are guaranteed by presenting a valid credit card at the time of reservation.
- No charges will be applied within the cancellation period. Exceptions may apply during holidays, special events or congresses.
- Cancellation Policy: flexible rate bookings may be cancelled within the timeframe established during the booking process. Cancellation policies vary depending on the selected rate. In case of cancellation outside the mentioned period or no-show, 100% of the total stay will be charged.
- SAVOY reserves the right to charge the penalty amount to the card provided.
- SAVOY reserves the right to refuse any booking that does not meet these requirements.


Non-Refundable Rates
- Bookings made under non-refundable rates require full payment (100% of the total stay) at the time of booking, and such amount is non-refundable.
- Cancellation Policy: non-refundable bookings do not allow for cancellations and no refund will be issued in the event of a no-show.


Group Bookings
- For bookings including more than seven (7) rooms, clients must contact the hotel directly before completing the reservation.
- In such cases, specific Group Terms and Conditions apply, which may include different policies for payment, cancellation, and special stay conditions.


Check-in and Check-out Procedures
- Check-in and Check-out Times:
 - Check-in: from 14:00
 - Check-out: by 12:00
- Full payment for the stay must be made upon arrival at the hotel.
- Upon check-in, a valid photo ID (citizen card, passport, or legally recognised document)
and a valid credit card must be presented, even for prepaid bookings, to guarantee any additional or incidental expenses.
- SAVOY reserves the right to pre-authorise the credit card to cover potential expenses during the stay.
- The pre-authorised amount may vary depending on the hotel unit, duration of the stay, and booking profile and will be
communicated
to the Client at check-in. This amount is not charged immediately but held on the card.
- Upon check-out and confirmation of no pending charges, the pre-authorisation will be released.
Fund availability depends on the issuing bank and is beyond SAVOY’s responsibility.
- Use of a credit card not held by the booking owner may be refused unless formally authorised by the cardholder.
- In the absence of a credit card, a cash deposit may be required. This will be fully refunded at check-out, deducting
any unpaid charges or verified damages caused by the Client.
- Card data will only be retained for the necessary period to ensure payment of charges incurred during the stay,
after which it will be securely deleted in accordance with General Data Protection Regulation (GDPR)
and the Privacy Policy.
- At check-out, the room must be vacated and free of persons and belongings.


Payment Terms
- SAVOY accepts payments in cash (within the legal limits applicable to cash transactions),
credit or debit cards, and bank transfers.


Special Requests
- SAVOY will make every effort to accommodate special requests made by Clients,
such as room location preferences, dietary requirements, early check-in or late check-out, among others.
- These requests are subject to availability upon arrival and may incur additional costs. Prior confirmation from the hotel is recommended.


Personal Data Protection
- SAVOY recognises the importance of protecting the privacy and personal data of its Clients.
Any personal information collected via this website or during the booking/check-in process will be handled in accordance with the GDPR. 

- Data Collected and Purpose: within the scope of bookings and stays, data such as full name, contact details (telephone, email, address),
ID document details (required at check-in), credit card information
(for guarantee/payment), and Client preferences or special requests may be collected.
- This data is used exclusively for the following purposes:
- Managing the booking and hotel stay, ensuring the provision of contracted services.
- Fulfilling legal obligations, including tax requirements
(issuing invoices, retaining billing data for legally defined periods).
- Ensuring transaction security: credit card data is securely processed,
solely for the purpose of reservation guarantees and authorised charges.
- Marketing purposes: only if the Client has provided consent,
contact details may be used for sending promotional communications.

Force Majeure
- SAVOY shall not be held liable for any failure or delay in fulfilling its contractual obligations if such failure or delay is caused by
circumstances beyond its reasonable control, including but not limited to 
natural disasters, fire,
flooding, earthquakes, war, terrorism, civil unrest, governmental acts, labour disputes, pandemics,
epidemics or any other event that could not have been foreseen or avoided with reasonable diligence (“Force Majeure Event”).
- In the event of a Force Majeure Event, the Client will be contacted as soon as possible with an explanation of the
situation and expected impact, and every effort will be made to mitigate its effect on the reservation or stay.
If the hotel is unable to meet its obligations due to a Force Majeure Event,
the reservation may be cancelled and an alternative date or refund will be
offered, without further liability.


Applicable Law and Jurisdiction
- These Terms and Conditions are governed by Portuguese law.
- Any disputes arising from the interpretation or application of these Terms and Conditions shall
be submitted to the competent courts of the judicial district of Funchal, with express waiver of any other jurisdiction.


Final Provisions
- The nullity or ineffectiveness of any clause of these Terms and Conditions shall not affect the validity of the remaining provisions.
